EXCEPŢIILE DE LA OBIECTIVELE DE MEDIU ÎN CONTEXTUL PLANURILOR DE MANAGEMENT ALE BAZINELOR HIDROGRAFICE DIN ROMÂNIA

EXEMPTIONS TO ENVIRONMENTAL OBJECTIVES UNDER THE CONTEXT OF THE RIVER BASIN MANAGEMENT PLANS FROM ROMANIA
Abstract. The river basin management plans represent the tool for the implementation of Water Framework Directive (WFD) stipulated by Article 13 and Annex VII and  having as purpose the balanced, sustainable water resources management as well as the protection of aquatic ecosystems through the achieving the main objective of “good status” of waters. In the situations where the achieving of environmental objectives is not possible, exemptions to environmental objectives under the conditions provided by Articles 4.4-4.7 of WFD could be applied. The paper presents some/several issues of the establishing process of exemptions to the water bodies level from Romanian river basins, as a  prioritization mechanism of the programme of measures in the field of water management from qualitative point of view. Based on the up-dated analysis of pressures and status/impact, correlated with the data provided by the up-dated risk analysis and by modeling, cost-efficiency and cost- benefit analysis, at the level of Romanian river basins, the result was that out of 3.3399 water bodies, 1241 water bodies cannot achieve good status/good potential before 2015, therefore being necessary to establish the water bodies to which exemptions to environmental objectives in 2015 are applied, as well as in the following planning cycles. In the case of water bodies to which exemptions are applied, the significant dominance was of exemptions with deadline extension under Article 4.4, followed by exemptions under Article 4.5. (less stringent environmental objectives) and under Article 4.7. (in relation to future infrastructure projects). It is mentioned that the number of water bodies to which exemptions are applied will decrease significantly in the following planning cycles, subsequently the environmental objectives are to be achieved by 2027, and the application of exemptions could be adapted in the next river basin management plans. As the new data and information will be available at the level of elements/activities used in the establishing of exemptions, these will lead to the development and improvement of the exemptions to water bodies level in the following planning cycles.
